场外配资型非法经营犯罪的侦查难点及对策研究——以第三方交易软件为视角

摘　　要：随着股市回暖,我国证券市场的场外配资活动又重新回到大众视野。场外配资若不加以监管极易引发股市动荡,我国学界对于场外配资型非法经营犯罪的研究较少,因此,有必要进行深入研究。当前第三方交易软件场外配资手段隐蔽、案情复杂,致使公安机关在办理此类案件时出现了线索发现难、调查取证难、确认主体难的问题。为有效遏制场外配资行为,公安机关应采取拓宽线索来源、深入分析案情、全面收集证据、情报主导侦查的专门侦查对策,对场外配资型非法经营犯罪进行全链条打击,以维护证券期货市场的安全与稳定。With the recovery of the stock market,the shadow margin financing in China’s securities market has become active again.Without supervision,this kind of financing can easily cause stock market turmoil.There are few studies on the shadow-margin-financing illegal business crimes in China,so it is necessary to conduct in-depth relevant research.At present,the shadow margin financing conducted on the third-party trading software is concealed and complex,resulting in difficulties in finding clues,investigating details,collecting evidence,and confirming the subject of such cases for public security organs.In order to effectively curb shadow margin financing,the public security organs should adopt special investigative countermeasures such as broadening the sources of clues,making in-depth case analysis,collecting evidence comprehensively,and taking intelligence-led investigation,to carry out a full-chain crackdown on the illegal business crime of shadow margin financing,so as to maintain the securities and futures market safe and stable.
