检察机关知识产权技术调查官制度研究

摘　　要：将技术调查官引入检察系统是为了给检察官办案提供专业知识方面的帮助,辅助检察机关在涉及专业知识的案件中充分履行公诉与监督职能,更好地应对实践中日益复杂专业化的知识产权刑事案件。该制度已经在我国知识产权审判中进行了实践,但是该制度还存在着检察院技术调查官的身份定位及责任承担不明、技术调查意见不公开容易导致控辩双方力量失衡等问题。为了该制度能够有效发挥其作用,在进行制度设计时应当从技术调查官的身份定位及聘请方式、工作职责、责任承担等多方面考虑制度本身的合理性与现有制度的协调,保证该制度能够科学有效地运行。The introduction of technical investigation officers into the procuratorial system aims to provide prosecutors with professional expertise,assisting procuratorial organs in fully fulfilling their prosecution and supervisory functions in cases involving specialized knowledge,and better addressing the increasingly complex and specialized intellectual property criminal cases in practice.This system has already been implemented in intellectual property trials in China.However,issues remain,such as the unclear identity and accountability of technical investigation officers within procuratorates,and the non-disclosure of technical investigation opinions,which may lead to an imbalance between the prosecution and defense.To ensure the effective functioning of this system,its design should consider the identity and appointment methods of technical investigation officers,their responsibilities,and accountability,among other aspects,to ensure the rationality of the system itself and its coordination with existing systems,thereby guaranteeing its scientific and efficient operation.
