摘　　要：从我国洗钱罪的立法发展历史看,可以得出洗钱罪系经济犯罪的结论,而经济犯罪应限定于侵犯动态经济运行过程的严重失范行为。法条竞合犯和想象竞合犯理论均否定洗钱罪“双重法益说”的成立,相较而言金融监管秩序“单一法益说”具有一定的合理性。主张和倡导对洗钱罪保护的法益进行实质判断,即洗钱犯罪侵害的法益主要在于货币资金来源和性质的掩饰、隐瞒。实务中,本犯不存在“提供资金帐户”的情形,“转换”和“销售”具有不同含义,洗钱罪中的“转移”与赃物犯罪中的“转移”区别在于有无实现洗白效果,通过向他人帐户内转账不宜认定为自洗钱,使用赃款购买房产或者车辆能否认定为自洗钱需要考察主观内容和行为方式,洗钱罪需要发生在金融领域并通过金融手段或者金融方式进行。From the legislative development history of money laundering in our country,it can be concluded that money laundering is an economic crime,and economic crimes should be limited to serious misconduct that infringes on the dynamic economic operation process.Both the statutory overlap crime theory and the imaginary overlap crime theory deny establishment of the“dual legal interests”of money laundering.In comparison,the“single legal interest”of financial regulatory order has certain rationality.It advocates to make a substantial judgment on the legal interests protected by money laundering,that is,the legal interests infringed by money laundering mainly lie in the disguise and concealment of the source and nature of monetary funds.In practice,the principal offender does not have the situation of“providing a capital account”,“conversion”and“sale”have different meanings,the“transfer”in money laundering differs from the“transfer”in property crimes in whether it achieves the effect of laundering transferring money,it is not appropriate to identify inward transfer through other people's accounts as self-laundering,whether buying real estate or vehicles with illicit money can be recognized as self-laundering needs to consider the subjective content and behavior,and money laundering must occur in the financial field and be carried out through financial means or methods.
