摘　　要：新冠疫情期间,由于存在疫情通过国际贸易途径传播这一新型风险,不少WTO成员国发布了疫情防控相关的技术性贸易措施通报,对特定地区的特定产品限制进口。根据《实施卫生和植物卫生措施协定》(《SPS协定》)相关要求,SPS措施的制定应以科学依据和风险评估为基础。而当时新冠肺炎属新发传染病,相关科学数据较为匮乏,难以进行客观的风险评估。本文以《SPS协定》为研究基础,综合分析涉及我国的SPS措施通报的合理性,进一步探讨海关卫生检疫在技术性贸易措施中的应用。During COVID-19 pandemic,due to the fact that COVID-19 may transmit via international trade,many WTO member states have established diseases prevention related measures restricting the importation of certain goods from epidemic areas.According to the Agreement on the Implementation of Sanitary and Phytosanitary Mea-sures(SPS agreement),SPS measures should be made on the basis of science and risk assessment.Unfortunately,as COVID-19 is an emerging new disease,the world’s science community has limited knowledge about this new pathogen and it’s hard to conduct relative risk assessment subjectively.Herein,based on the SPS Agreement,we analyzed the legitimacy of the SPS measures posted by WTO member states and explored how to apply Customs quarantine work in the field of tecnical barriers to trade.
