体育旅游数字化转型的法律风险及其规制策略

摘　　要：体育旅游数字化转型是实现中国式体育旅游现代化的必然要求。运用文献资料、逻辑分析等研究方法,探析体育旅游数字化转型的价值意蕴,从公权、私权、共权三层面剖析其法律风险并施以规制策略。研究认为,体育旅游数字化转型使其治态、业态、界态三维度得以重塑,但在其转型中仍存在法律规范制定失准、行政权力施行失位、司法解纷处置失当、数字市场规制失控、用户隐私权利失守、体旅数据确权失灵、数实融合体系失效、数字转型秩序失调、社会价值监管失范等法律风险,由此提出:平衡型法理构造与动态化规则重塑;基于控权增能善治“数字利维坦”;创设司法良序下法治生态机制;建构开放型数字体旅市场秩序;嵌入法治的数字体旅生态信托;构建“三权分置”的数据产权制度;推动双向融合的数实循环规制;构建均等包容的数字体旅秩序;塑造数字体旅的理性价值导向。The digital transformation of sports tourism is an inevitable requirement for the modernization of sports tourism with the Chinese characteristics.Adopting literature review and logical analysis,this study explored the value implications of the digital transformation of sports tourism,analyzed its legal risks from three perspectives:public rights,private rights,and shared rights,and proposed regulation strategies.The research found that the digital transformation of sports tourism reshaped its governance,business,and boundary dimensions.However,there were still legal risks in the process of transformation,including the misalignment of legal regulations,improper implementation of administrative powers,inadequate judicial dispute resolution,lack of control over digital market regulation,loss of user privacy rights,failure in the determination of sports tourism data ownership,inefficiency in the integration of digital and physical systems,disorder in digital transformation,and irregularities in the regulation of social value.Based on these findings,this paper proposed a balanced legal structure and dynamic regulatory reforms,empowering governance through control of power and enhancing the role of digital Leviathan,establishing a judicially sound legal ecosystem;creating an open digital sports tourism market order;embedding legal governance in the digital sports tourism ecosystem trust,constructing a“three rights separation”data ownership system,promoting a bidirectional integration of digital and physical regulation,building an inclusive and equitable digital sports tourism order,and shaping a rational value orientation for digital sports tourism.
