论“法律奇点”语境下人工智能与法律的关系

摘  要:“法律奇点”话题是“人工智能与法律”交叉课题研究中的一个前沿性学术问题。法律奇点论者心目中的法律奇点,就是法律智能化发展的顶峰,它将对人工智能立法、算法对法律适用的赋能、人工智能在司法审判中的运用等法律科技和智慧司法问题产生重要影响。在法律科技发展目标维度上,法律奇点论者将法律奇点作为人工智能机器立法和算法赋能促进法律完善的新航标,对这个理想目标我们应予以肯定与弘扬;在智慧司法完善进程维度上,法律奇点论者所讨论的未来智能机器可能替代法官审理案件的愿景不符合人工智能治理原则与司法审判制度内在国家机器属性。未来在“人工智能与法律”的关系上,司法审判应然模式必须坚持人类法官在司法审判中的主体性,智能机器可以成为法官判案的工具但绝不能获得审判权替代法官判案。The topic of“legal singularity”is a cutting-edge academic issue in the integration of“artificial intelligence(AI)and law”.For legal singularity theorists,the legal singularity represents the peak of legal intelligence development,with significant implications for legal technology and intelligent judicial processes,including AI legislation,algorithm empowerment in law application,and the use of AI in judicial trials.In the dimension of the development goal of legal technology,legal singularity theorists regard legal singularity as a new beacon for AI-driven legislation and algorithm empowerment to enhance the law,a goal that should be recognized and promoted.However,in the dimension of the process of improving intelligent justice,the ideal vision discussed by legal singularity theorists,that future intelligent machines may one day replace judges in handling cases,does not align with the principles of AI governance or the inherent role of the judiciary in state apparatus.In the future,the relationship between AI and law,the ideal mode of judicial trial,must adhere to the subjectivity of human judges in judicial adjudication,and intelligent machines can only serve as tools to assist judges in hearing cases,but should never replace human judges in exercising judicial authority.
