摘　　要：捕诉关系调整作为一项检察内部事权,相应地“捕诉分离”与“捕诉一体”各有利弊,理论与实务之间存在着一种“公说公有理,婆说婆有理”的混乱局面,亟需通过虚拟场景之下的法学实验进行假设验证。其中,选择以“权力模式”和“权力逻辑”为自变量,以及“捕”和“诉”的独立裁决为因变量,典型案例测试之下的数据显示“权力逻辑”与“捕”“诉”精准率高度关联,而“权力模式”并非显性影响因素,“捕诉一体”改革有利于提升司法效能,但也存在着标准混同的治理风险。基于检察工作现代化转型的时代背景,需要进一步检察理念革新,重申比例原则,保障审查逮捕的程序正义;检察制约创新,淡化行政模式,彰显检察权力的司法属性;检察考评调整,尊重司法规律,激发检察能动的主观意愿。As an internal procuratorial authority,the adjustment of the arrest-prosecution relationship,which refers to either“the separation of arrest and prosecution”or“the integration of arrest approval and public prosecution”,has its own advantages and disadvantages.There is a chaotic situation between theory and practice,where“each side has its own reasoning.”Therefore,it needs to be verified by hypothesis testing through legal experiments under virtual scenes.Among them,the“power model”and“power logic”are selected as independent variables,and the independent decisions of“arrest”and“prosecution”are selected as dependent variables.The data under the typical case test show that“power logic”is highly correlated with the accuracy rate of“arrest”and“prosecution”,while“power model”is not a dominant influencing factor.The“integration of arrest approval and public prosecution”reform helps improve judicial efficiency but also carries the risk of governance issues with mixed standards.Based on the background of modern transformation of procuratorial work,it is necessary to further reform the procuratorial concept,reaffirm the principle of proportionality,and guarantee the procedural justice of arrest approval,innovate the procuratorial restriction,dilute the administrative mode,and highlight the judicial attribute of procuratorial power,adjust the procuratorial evaluation,respect the law of justice and stimulate the subjective will of procurators.
