论学术复核制度的体系化建构——以《学位法》第40条为中心

摘  要:《学位法》第40条创新性规定了学术复核制度。学术复核是学位授予过程中针对学术争议的专门救济制度,发挥保护学位申请人合法权益、自我纠错、健全多元化纠纷解决机制等功能,与学位复核、校内申诉、行政复核等制度有着本质区别。学术复核制度建构需要注意受理范围在法定情形外是否有继续拓展的空间、学术复核的受理机构和复核专家如何选择、学术复核的程序运作是否符合正当程序要求、学术复核办法的制定是否存在瑕疵等问题。在此基础上,从划定学术复核受理范围的边界、明确学术复核的相关主体、健全学术复核程序规则、探索学术复核办法备案审查机制四个方面进行体系化建构。Article 40 of Degree Law of the People's Republic of China innovatively stipulates the academic review system.Academic review is a special relief system for academic disputes in the process of degree awarding.It has functions such as protecting the legitimate rights and interests of degree applicants,self-correcting errors,and perfecting diversified dispute resolution mechanisms.It is fundamentally different from degree review,on-campus appeals,administrative review and other systems.The construction of academic review system needs to pay attention to such issues as whether there is room for further expansion of the scope of acceptance outside the legal circumstances,how to select the acceptance institutions and experts for academic review,whether the operation of academic review procedures meets the requirements of due process,and whether there are defects in the formulation of academic review methods.On this basis,the systematic construction is carried out from four aspects:delineating the boundaries of the acceptance scope of academic review,clarifying the relevant subjects of academic review,perfecting the procedural rules of academic review,and exploring the filing and review mechanism of academic review methods.
