《学位法》中学位程序制度建构的实践逻辑

摘　　要：学位程序制度从保护学位申请人权利的司法实践中发展而来,最终为权利保障实践所检验。程序性审查成为学位行政司法策略性救济学位申请人权利实践的最佳选择,主要表现为学位行政争议司法审查在范围上以程序审查为主、实质审查为辅,在强度上呈现程序强审查、实体弱审查的特征。其原因在于学位行政内嵌学术权力属性,造成监督制约实践难题。回应学位行政法治,学位程序制度发展历经学位程序规范结构性短缺、司法逐步形成正当程序规范、学位程序基本制度确立三个阶段。实施《学位法》保护学位申请人权益,需充分发挥制度客观法和主观权利面向的双重权利保障机能提升权利保护效率,加强学位程序规范体系化和学位行政行为规范化建设实现学位行政的良法善治,善用司法的解释与形成性功能强化学位程序制度的社会适应性。The system of degree procedures has developed through judicial practices aimed at protecting the rights of degree applicants and has ultimately been tested in the practice of protection of degree rights.Procedural review has become the most effective strategic judicial remedy for protecting the rights of academic degree applicants in administrative disputes,characterized by a focus on procedural review with substantive review playing a secondary role.This is due to the inherent academic authority within degree administration,which presents challenges for effective supervision and regulation.The development of the degree procedural system has progressed through three stages:a structural deficiency in procedural norms,the gradual establishment of due process norms through judicial practice,and the creation of a basic degree procedural system in response to the rule-of-law practices in degree administration.To implement Degree Law and protect the rights of academic degree applicants,it is essential to maximize the dual function of safeguarding rights through both objective law and subjective rights,enhancing protection efficiency.This requires strengthening the systematization of degree procedural norms and the standardization of administrative actions to achieve good governance.Moreover,judicial interpretation and formative functions should be effectively utilized to strengthen the adaptability of the degree procedural system to societal needs.
