摘　　要：民族地区乡村法治建设是民族地区乡村振兴的应有之义。软法与硬法是民族地区乡村振兴法治建设的一体两面,硬法以其权威性与刚性厘定乡村振兴制度框架,保障民族地区乡村良善治理;软法以其亲民性与柔性激发乡村社会治理活力,促进民族地区乡村社会和谐。然而,在民族地区乡村振兴进程中,存在软法之于硬法的碰撞与冲击和硬法之于软法的挤压与弱化双重困境。面向未来,我国民族地区乡村社会中,软法与硬法应遵循合作共治的治理逻辑,既要积极构建软法与硬法间的冲突解决机制,也要持续优化软法与硬法间的共生共治机制。The construction of the rule of law in rural areas of ethnic regions is an essential part of the revitalization of rural areas in ethnic regions.Soft law and hard law are the two sides of the rule of law construction of rural revitalization in ethnic areas.The hard law determines the institutional framework of rural revitalization with its authority and rigidity,and guarantees the good governance of rural revitalization in ethnic areas.Soft law stimulates the vitality of rural social governance and promotes the harmony of rural society in ethnic areas with its affinity and flexibility.However,in the process of rural revitalization in minority areas,there exists a double dilemma of collision and impact between soft law and hard law and squeeze and weaken between hard law and soft law.Facing the future,soft law and hard law should follow the governance logic of cooperation and co-governance in the rural society of ethnic areas in China,which should not only actively build a conflict resolution mechanism between soft law and hard law,but also continuously optimize the symbiotic co-governance mechanism between soft law and hard law.
