摘  要:最高人民法院已通过司法解释的形式明确规定了林业碳汇认购替代生态修复方式的裁判规则,这既是对“碳达峰”“碳中和”战略目标的司法回应,也是对生态环境替代性修复路径的有益拓展。通过检视当前实践发现,该方式存在被不规范适用、碳汇损失核算标准混乱、修复裁判的执行与监督机制不健全以及适用范围扩张空间失序等问题,掣肘着其实践效能的发挥。据此,提出加紧研究出台细化性规定并推动相关立法,明确该方式的司法适用要求,制定林业碳汇损失核算标准体系,健全碳汇认购的执行与监督机制等规范化发展策略,以推动林业碳汇修复方式更好地发挥实效。同时还应厘清林业碳汇修复方式的适用范围边界,以合理挖掘其潜在的生态服务价值。The Supreme People′s Court had clearly stipulated the adjudication rules for the subscription of forestry carbon sink alternative ecological restoration mode through judicial interpretation,which was not only a judicial response to the“Dual Carbon”target,but also a beneficial expansion of the alternative ecological environment restoration path.Reviewing the current practice found that the value of this method was often hampered by problems such as non-standard application,chaotic accounting standards for carbon sink losses,imperfect implementation and supervision mechanism of restoration judgment,and disorderly expansion space of application scope.Accordingly,relevant laws and detailed regulations should be formulated and promulgated to clarify the judicial application requirements of the restoration method,formulate the accounting standard system of forestry carbon sink loss,and improve the implementation and supervision mechanism of carbon sink subscription,so as to promote the effectiveness of the restoration method.At the same time,the boundary of the application scope of the restoration method should be clarified in order to reasonably tap the potential ecological service value of this method.
