高校行政性规则法律规范的理论阐释、现实问题与优化路径

摘　　要：高校与学生间存在“多元法律关系结构”,用以调整这一法律关系的学校规则存在学术性与行政性之分。本文分析高校对学生惩戒行为的司法审判实践,发现高校行政性规则在制定与适用中存在一定问题,会对学生基本权利产生不利影响。要调和这一矛盾,应在厘定学术性规则与行政性规则权限边界的基础上,以法律规范校内行政性规则的制定与适用。There exists“multiple legal relationships structure”between universities and students,there is a distinction between academic and administrative school rules used to adjust this legal relationship.Analyzing the judicial trial practice of disciplinary actions against students in universities,it was found that there are certain problems in the formulation and application of administrative rules in universities,which might adversely affect the basic rights of students.In order to reconcile this contradiction,it is necessary to standardize the formulation and application of administrative rules in universities by laws based on the boundary between the competence of academic and administrative rules.
