摘  要:通过老年人就业教育立法,为老年人就业教育提供法制保障,进而提升老年人职业技能,促进老年人就业,已是域外老龄化国家挖掘和开发老年人人力资源、应对老龄化危机的基本策略之一。我国正步入深度老龄化,有必要借鉴域外立法经验,来完善我国老年人就业教育立法。通过审视分析域外老年人就业教育立法文本,对代表性立法的价值归依、技术特征、关键内容进行分析,得出在平等权基础上赋权增能、以综合立法为基本立法技术特征、强化专项资金支持为关键内容等三个方面立法经验。基于此,在进一步剖析我国老年人就业教育立法现状基础上,探寻立法完善进路。One of the basic strategies for aging countries to explore and develop human resources for the elderly and respond to the aging crisis is to legislate for employment education for the elderly,to provide legal protection for employment education for the elderly,to enhance their vocational skills and to promote their employment.China has entered a deep aging population,and it is necessary to draw on legislative experience from overseas to improve the legislation on employment education for the elderly in China.By examining and analyzing the legislative texts on employment education for the elderly in other countries,this paper analyzes the value attribution,technical characteristics and key content of representative legislation and concludes experiences in three aspects:empowering on the basis of equal rights,using comprehensive legislation as the basic legislative technical feature and strengthening special funding support as the key content.Based on this,by further analyzing the current situation of legislation on employment education for the elderly in China,we will explore ways to improve legislation.
