摘 要:行政犯与刑事犯区别的实质标准在于法益内容:前者侵害秩序法益,后者侵害安全法益。行政犯的双重违法性便是上述区别在刑法立法上的表现,且这种双重违法性仅存在于行政犯领域。目前我国刑法立法并未重视行政犯的特殊性,部分行政犯或欠缺前置违法性构成要素,或欠缺前置法规定。前置违法性决定了行政犯的从属性和谦抑性特征,而刑法独立性不应适用于对双重违法性的解读。以此为指引,行政犯刑法立法必须以前置法规定为前提条件,以前置违法性为构成要素,以行政犯与行政法的规定相一致为基本原则。The essential standard of the difference between administrative crimes and criminal offenses lies in the content of legal interests:the former infringes on the legal interests of order;the latter infringes on the security legal interests.The dual illegality of administrative crime is the manifestation of the above differences in criminal law legislation.Moreover,this dual illegality only exists only in the field of administrative crimes.Currently,China’s criminal legislation does not fully recognize the uniqueness of administrative crimes.Some administrative crimes either lack the constitutive element or the provisions of pre-law.The illegality of pre-law of administrative crime determines the dependent and restrained nature of administrative crimes,while the independence of criminal law is not applicable to this field.Taking this as a guide,the criminal law legislation of administrative crime must take the previous provisions of the law as the prerequisite,take the pre-illegality as the constituent element,and take the consistency between administrative crime and the provisions of administrative law as the basic rule.
