摘  要:数智时代,AI技术的深度发展和广泛运用,使人工智能生成式艺术(AIGA)形式应运而生。AI系统并不具有人格,但能够生成不逊色于传统艺术的成果,该成果能否受到法律的保护,对AIGA的发展具有决定作用。根据AIGA成果的生成原理和法律属性,AIGA的“创作”实际上是一个数据的运用和处理过程,不符合著作权法上创作的要求,因此不享有著作人身权。产生的成果是艺术产品和数据产品的融合,具有一定的创造性和商业价值,可以通过著作财产权益和数据财产权益给予保护。正确适用现行法律制度,协调AIGA的技术特性与法律属性、技术创新与财产创造的关系,为AIGA发展提供法制保障。In the era of digital intelligence, the in-depth development and extensive use of Artificial Intelligence(AI) technology has led to the emergence of Artificial Intelligence Generative Art(AIGA), an AI system that does not have a personality, but can generate results that are no less than those of traditional art, and whether or not the results can be protected by the law is decisive for the development of AIGA. According to the principle and legal attributes of the results of AIGA, the “creation” of AIGA is actually a process of using and processing data, which does not meet the requirements of creation under the copyright law, and therefore does not enjoy the right of authorship. The result is a fusion of art products and data products, with certain creativity and commercial value, which can be protected by copyright and data property rights. Several points should be noted: correctly applying the current legal system, coordinating the relationship between the technical characteristics and legal properties of AIGA, technological innovation and property creation, and providing legal protection for the development of AIGA.
