摘　　要：2020年5月29日,习近平总书记指出,要“加强对民事法律制度的理论研究,尽快构建体现我国社会主义性质,具有鲜明中国特色、实践特色、时代特色的民法理论体系和话语体系”。清末以降,公序良俗作为中国民法基本原则之一。它为近代民法体系的建构灌注了中国精神,将中华优秀传统道德观与现代法律紧密联系,符合中国人民对道德理想的追求。现有研究观点认为,公序良俗发端于西方民法文化。但从法律发展史来看,其所体现的法律精神及行为规则是各国民事规范的源头活水。本文从法理的角度解读公序良俗的基本义理,以发掘其当代价值,从而达到完善中国特色社会主义民法理论体系的目的。On May 29,2020,General Secretary Xi Jinping emphasized the need to"strengthen theoretical research on civil legal systems and to rapidly establish a civil law theory and discourse system that reflects the socialist nature of our country,characterized by distinct Chinese features,practical relevance,and contemporary significance."Since the late Qing Dynasty,the principle of public order and good morals has been recognized as one of the fundamental principles of Chinese civil law.It infuses the modern civil law system with Chinese spirit,closely linking traditional moral values with contemporary legal frameworks,thereby aligning with the moral ideals pursued by the Chinese people.Current research often posits that the concept of public order and good morals originates from Western civil law culture.However,from the perspective of legal history,the legal spirit and behavioral norms it embodies serve as a wellspring for civil regulations across various countries.This paper aims to reinterpret the connotation of public order and good morals,exploring its core meanings,characteristics,and contemporary value to solidify the theoretical foundation of the socialist civil law system with Chinese characteristics.
