数字社会网络犯罪地域管辖制度的优化路径

摘　　要：数字社会信息网络视阈下刑事案件的地域管辖问题已经成为打击信息网络犯罪的首要障碍。当前,在地域管辖制度的实践运用中,扩张性地对“犯罪地”进行泛化适用已然造成管辖冲突局面,还存在管辖竞合处理程序失灵及协商管辖与指定管辖的内在冲突等困境。为了应对网络犯罪中适用地域管辖制度产生的突出问题,应建立“犯罪地”认定的动态判断规则,完善“犯罪地为主、居住地为辅”的地域管辖原则,重构管辖权竞合处理标准,并健全管辖制度的配套机制,对传统地域管辖理论制度在网络犯罪下的适用路径不断进行优化与发展。The issue of territorial jurisdiction over criminal cases in the context of the information network in the digital society has become the primary obstacle to combating information network crimes.Currently,in the practical application of the territorial jurisdiction system,the expansive and generalized application of“the place of crime”has already led to a situation of jurisdictional conflicts.There are also difficulties such as the malfunction of the handling procedures for jurisdictional concurrence and the internal conflicts between negotiated jurisdiction and designated jurisdiction.In order to address the prominent problems arising from the application of the territorial jurisdiction system in cyber crimes,a dynamic judgment rule for the determination of“the place of crime”should be established,the territorial jurisdiction principle of“giving priority to the place of crime and supplemented by the place of residence”should be improved,the handling standards for jurisdictional concurrence should be reconstructed,and the supporting mechanisms of the jurisdiction system should be perfected,so as to continuously optimize and develop the application paths of the traditional territorial jurisdiction theoretical system in the context of cyber crimes.
