摘　　要：《民法典》第一百二十七条作为网络游戏虚拟财产可被纳入执行财产范围的主要依据,尚不足以应对司法实践的复杂挑战,同案不同判的现象频频发生,影响了执行质效。网络游戏虚拟财产虚拟性和附着性的特质使其处于传统执行网络查控系统的盲区,交易隐蔽性的特征也使其极易成为被执行人逃避执行的工具。因此,为更好地保护当事人的合法权益并缓解当下“执行难”的困境,应明确网络游戏虚拟财产的法律属性、廓清网络游戏虚拟财产的权利归属、健全相关法律规定、充分发挥运营商的协助作用、强化媒体宣传推介功能、完善执行程序与方式,全方位构建起网络游戏虚拟财产执行长效机制。The inclusion of virtual property in online games as a novel asset within the scope of executable property primarily hinges on Article 127 of The Civil Code.However,this provision falls short in addressing the intricate challenges encountered in judicial practice,resulting in frequent discrepancies in judgments for similar cases,which undermines the quality and efficiency of execution.The intangible and attached nature of virtual property in online games places it in a blind spot for traditional network inspection and control systems.Moreover,the concealed nature of its transactions facilitates its use as a means for individuals subject to execution to evade legal procedures.To better safeguard the legitimate rights and interests of all parties involved and alleviate the prevailing execution dilemma,it is essential to elucidate the legal attributes of virtual property in online games,clarify right ownership of such property and enhance pertinent legal provisions.Moreover,we are also expected to fully leverage the assistance role of operators,intensify media publicity and promotion,and refine execution procedures and methodologies.Only in this way,can we establish a long-term mechanism for the execution of virtual property in online games from all aspects.
