监察证据与刑事诉讼证据衔接的问题研究

摘　　要：监察体制改革后,党的纪律检查委员会与行政监察机关合署办公,设立了具有中国特色的监察机关。改革将原本分散于不同机关的监督权,以集中行使监察职权的方式进行整合,形成监察合力,实现监督权力结构的优化,形成了系统的国家权力监督体系。监察委员会作为开展廉政建设和进行反腐败斗争的核心枢纽,产生了独立于行政权、检察权、司法权的监察权。然而新型权力体系的出现必然带来与原有的法律体系的冲突与适应,产生监察证据与刑事诉讼证据之间的衔接问题,如证据种类不一致、证据标准模糊等。而这些问题的解决需我们在两法的整体逻辑基础上,探讨符合两法内在统一的衔接路径,推进两法之间的缓适,促进监察程序与刑事诉讼程序的衔接贯通。After the reform of the supervision system,the Party’s Disciplinary Inspection Committee and the administrative supervision organs worked together and established a supervision organ with Chi-nese characteristics.The reform has integrated the supervisory powers that were originally scattered in different organs in the form of centralized exercise of supervisory powers,formed a joint force of supervi-sion,optimized the structure of supervisory powers,and formed a systematic system of supervision of state power.As the core hub for building a clean and honest government and waging the anti-corruption struggle,the Supervision Commission has produced a supervisory power that is independent of the execu-tive,procuratorial,and judicial powers.However,the emergence of a new type of power system will inevitably bring about conflicts and adaptations with the original legal system,and there are problems of connection between supervision evidence and criminal procedure evidence,such as inconsistent types of evidence and vague evidence standards.The solution to these problems needs to be based on the overall logic of the two laws,explore the convergence path that conforms to the internal unity of the two laws,promote the relaxation between the two laws,and promote the connection between the supervision proce-dure and the criminal procedure.
