摘 要:以157份裁判文书为样本,分析借名买房案件的审判现状及主要争议焦点。当前,司法实践中对借名买房合同效力的认定和房屋物权归属的处理存在较大分歧:关于合同效力的认定分歧主要集中在借名买房是否违反公序良俗、法律强制性规定等方面;关于物权归属的分歧主要集中在出名人是否有权处分该房产。应根据借名买房的具体目的和行为特征认定合同效力,同时在物权归属问题上结合是否涉及第三方交易进行综合判断,平衡借名人、出名人及第三方的利益。Sampling 157 judicial documents,this paper examines the judicial landscape and key issues in disputes over“buying a house under a borrowed name”.Currently,there is significant divergence in judicial practice regarding the determination of the validity of contracts for buying a house under a borrowed name and the handling of property ownership:The main divergence in determining contract validity focuses on whether such transaction violates public order and good morals or mandatory legal provisions;the major divergence in property ownership revolves around whether the nominal owner has the right to dispose the property.This paper suggests that the validity of the contract should be determined based on the specific purpose and characteristics of the“buying a house under a borrowed name”,while the problems concerning property ownership should be judged based on whether a third-party transaction is involved,so as to balance the interests of the actual owner,the nominal owner,and the third parties.
