私法视域内政府嵌入小区治理的学理基础、理论完善与制度建构

摘　　要：在小区自治机制失灵的背景下,基于国家与社会的良性互动机制和新时代“枫桥经验”的理论内涵与实践经验,政府嵌入小区治理将有利于克服小区治理的组织化困境与串联机制缺失等困境。不过,在私法视域内,小区治理作为私法自治理念的延伸,存在排斥政府公权介入的理论障碍。从私法与公法关系的动态演进以及国家和社会治理现代化的视角来看,一方面,公法与私法在保障私权的根本旨趣上具有目的上的一致性,私法自治的失灵需要国家公权力的介入予以矫正;另一方面,在国家与社会治理现代化的功能性需求下,国家和社会治理的现代化需要公法与私法的互相协同予以保障。以此为据,可根据小区治理的实践困境和政府嵌入小区治理的内在逻辑进行相应的制度建构,并在以法治保障社会治理现代化的背景下对政府嵌入小区治理进行必要的规范确认。In the context of the malfunction of the community self-governance mechanism,based on the positive interaction mechanism between the nation and society as well as the theoretical connotations and practical experiences of the“Fengqiao Experience”in the new era,the embedding of community governance can help overcome organizational difficulties in community management and the lack of coordination mechanisms.However,from the perspective of private law,community governance,as an extension of the concept of private law autonomy,faces theoretical obstacles that exclude the intervention of government public authority.From the dynamic evolution of the relation between private law and public law,as well as from the viewpoint of state and social governance modernization,on the one hand,public law and private law share a common purpose in protecting private rights,and the malfunction of private law autonomy requires intervention by state public power for correction;on the other hand,under the functional demands of modernization of state and social governance,the modernization of governance requires mutual coordination between public law and private law.Based on this,corresponding institutional construction can be made according to practical dilemmas of community governance and the inherent logic of government embedding in community governance.Necessary normative confirmation of government embedding in community governance can be carried out to ensure the modernization of social governance with the rule of law.
