摘　　要：托育服务立法对于明确托育服务的性质与定位、破解托育服务遭遇的种种现实问题、保障家庭和0~3岁婴幼儿照护权益、支撑人口长期均衡发展均具有重要的价值。当前,我国托育服务立法面临着政策法律化进程迟滞、立法共识性欠缺、管理体制不完善、地方立法经验不足等挑战。为了推进托育服务立法科学化、法制化和规范化发展,建议强化顶层设计,推动托育服务法律体系的构建;重塑法治观念,凝聚立法社会共识;突破体制壁垒,构建多元共治格局;加强地方立法,丰富立法的实践经验。Legislation on childcare services can not only clarify the nature and positioning of childcare services and solve the practical problems encountered by childcare services,but also protect the rights and interests of families and the care of infants and children aged 0~3 years old,and support the long-term balanced development of the population.China′s legislation on childcare services now faces many challenges,such as the slow process of policy legalization,lack of legislative consensus,imperfect management system and insufficient local legislative experience.In order to advance the legislation on childcare services and promote its scientific,legal and standardized development,this paper suggests to strengthen the top-level design and promote the construction of the legal system of childcare services;reshape the concept of rule of law and form consensus of legislative society;break through the institutional barriers and build a pattern of pluralistic co-governance;and strengthen local legislation to enrich the practical experience of legislation on childcare services.
