摘 要:距不完全劳动关系首次提出已三年有余,但是我国立法机关却并未围绕不完全劳动关系出台新的规定,致使我国理论界对其性质、内涵及界定标准等问题争议不断。结合我国新业态劳动者的用工特点来看,不完全劳动关系因具备一定用工自主权而呈现弱从属性,可视为劳动关系的特殊状态。在劳动法增设不完全劳动关系规定的同时,应当考虑对其他劳动保障缺口适用之可能性,从功能上取代雇佣关系。最后,基于事实优先原则,以用工自主权、生产资料所有权等要件对不完全劳动关系予以类型化区分,基于从属性之强弱予以递进式认定。Three years have passed since the first introduction of incomplete labor relations,but the legislative framework has not issued new regulations regarding the incomplete labor relations,which result in constant disputes over its nature,connotation and definition standards among the academics.According to the employment characteristics of the new type of labors,incomplete labor relations show weak subordination as they have certain employment autonomy,which can be regarded as a special status of labor relations.In addition to the provision of incomplete labor relations in the labor law,the possibility of applying other labor security gaps should be considered to replace the employment relationship functionally.Finally,based on priority in stating the facts,incomplete labor relations are classified according to labor autonomy,ownership of means of production and other elements,and identified according to the strength of subordination.
