我国完善知识产权判决跨境承认与执行制度对策研究

摘　　要：知识产权判决的跨境流动对促进和保障知识产权跨境合作与交流,减少知识产权领域的国际平行诉讼意义重大。海牙国际私法会议在推动知识产权判决跨境承认与执行过程中,鉴于各国在知识产权内涵、非金钱救济纳入、判决审查机制及管辖权规则等方面存在重大分歧而没有达成共识。这源于知识产权判决跨境承认与执行中地域性的阻碍、公共政策的差异、国家间互惠原则适用的标准不同以及现实主义与自由主义的立场冲突。为更好地处理与知识产权有关的国际私法问题,我国应通过构建知识产权绝对地域性与相对地域性相结合的分类规制方式、审慎适用并完善知识产权公共政策、建立多元化知识产权判决跨境互惠承认机制等措施以应对上述困境与挑战,从而促进我国知识产权判决跨境承认与执行制度的完善与规范化发展。The cross-border flow of Intellectual Property judgments is of great significance in promoting and safeguarding cross-border cooperation and exchange,and reducing international parallel litigation.Given the significant differences among countries regarding the content of Intellectual Property,inclusion of non-monetary remedies,review mechanisms for judgments,and jurisdictional rules,the Hague Conference on Private International Law did not reach a consensus in promoting cross-border recognition and enforcement of Intellectual Property judgments.This is due to regional barriers in cross-border recognition and enforcement of Intellectual Property judgments,differences in public policies,different standards for applying the principle of reciprocity between countries,and conflicts between realism and liberalism.In order to better handle international private law issues related to Intellectual Property,China should adopt a classification and regulation system that combines absolute and relative territoriality,prudently apply and improve public policies,establish a diversified mechanism for cross-border reciprocal recognition of Intellectual Property judgments,and other measures to address the above difficulties and challenges,thereby promoting the improvement and standardized development of China’s system for cross-border recognition and enforcement of Intellectual Property judgments.
