推进教育强国建设的法治价值遵循及其实践进路

摘　　要：法治是推动教育强国建设行稳致远的重要保障。教育强国建设要求以良法保障教育发展,促进教育善治,以教育法治之强夯实教育强国之基。秩序、效率和正义是在法治轨道上推进教育强国建设的基本价值遵循,建设教育强国需要法律以其秩序价值保障教育稳定有序,以效率价值促进教育高质量发展,以正义价值维护教育公平。推进教育法治化,在秩序价值基础之上,效率与正义价值并重,有重点地促进公平,高效率地提升质量,方能保障教育强国目标的实现。为此,应以法治价值为引领,通过教育法法典化和教育立法方式优化为教育强国构筑法治基础,通过对教育执法体制机制的建立健全,把法治优势转化为推进教育强国建设的治理效能,以公正司法筑牢教育强国的法治屏障,以全民守法夯实教育强国的法治根基。The rule of law is an important guarantee for the steady and long-term development of China's education.The building of a powerful country in education requires the development of education and the promotion of the good governance of education with good laws,and the consolidation of the foundation for a powerful country in education through the rule of law.Order,efficiency and justice are the basic value in the promotion of the building of a powerful country in education on the track of the rule of law.The building of a powerful country in education requires the law to ensure the steady order of education through the value of its order,promote the high-quality development of education through the value of its efficiency,and maintain equity in education through the value of its justice.In the promotion of the rule of law in education,we should,based on the value of order,attach equal importance to the value of efficiency and justice,promote equity in important areas,and improve quality efficiently so as to ensure the achievement of the goal of building of a powerful country in education.Therefore,under the guidance of the value of the rule of law,we need to establish a rule-oflaw foundation for the building of a powerful country in education through the codification of the education law and the optimization of the mode of education legislation,transform the advantages of the rule of law into the governance efficiency of promoting the building of a powerful country in education through the establishment of a sound institutional mechanism for the enforcement of the education law,strengthen the rule-of-law guarantee for the building of a powerful country in education through fair justice,and consolidate the rule-of-law foundation for the building of a powerful country in education through the observation of the law by all.
