摘 要:在人工智能技术迅猛发展的当下,借助人工智能辅助司法审判已成为不可阻挡的趋势,其对促进司法公正、提升司法效率具有重要意义。然而,人工智能审判存在诸多问题,如法官自由裁量权受限、算法黑箱导致的不透明与歧视现象、可能生成虚假信息等,这些问题在伦理和司法程序层面引发了一系列难题,严重影响审判的公正透明性。文章运用理论探讨与案例分析相结合的方法,深入剖析这些问题,并以公正审判为视角提出针对性的构建策略:明确人工智能辅助审判的定位,确保审判人员主导自由裁量权;从多方面修补算法弊端,增强算法透明度;加强对人工智能虚假信息的防范,规范信息来源并提升司法人员辨别能力。In the current era of rapid development of artificial intelligence technology,it has become an irresistible trend to use artificial intelligence to assist in judicial trials.It is of great significance for promoting judicial justice and improving judicial efficiency.However,there are many problems in artificial intelligence trials.For example,the lack of judges'discretionary power,the opacity and discriminatory phenomena caused by the algorithmic black box,and the possible generation of false information.These problems have triggered a series of difficulties at the ethical and judicial procedure levels,seriously affecting the fairness and transparency of trials.This article deeply analyzes these problems through a combination of theoretical exploration and case analysis.From the perspective of fair trials,it proposes targeted construction strategies:clearly defining the positioning of artificial intelligence in assisting trials to ensure that judges dominate the discretionary power;repairing algorithmic disadvantages from multiple aspects to enhance algorithmic transparency;and strengthening the prevention of false information generated by artificial intelligence by standardizing the information sources and improving the ability of judicial personnel to distinguish false information.
