摘　　要：取保候审是刑事诉讼中一项重要的非羁押性强制措施。在司法实践中犯罪结构和刑罚逐渐轻缓化趋势下,2022年“两高两部”对《关于取保候审若干问题的规定》进行了修订,明确应当取保候审的对象,强化执行监管,完善配套监管措施以及规范工作衔接,进一步放宽了适用条件,增强了可操作性。检视之下,取保候审的预期价值并未完全释放,仍然存在认罪认罚案件取保候审适用率偏低,社会危险性条件的评估标准不清晰,保证方式、监管技术及机制不完善等问题。需要进一步扩张取保候审的适用范围,建立科学的社会危险性量化评估机制,增加保证方式,深化数字监控,明确监管义务等配套机制,贯彻落实少捕慎诉慎押的刑事司法政策,保护公民合法权益。Bail pending trial is an important non-custodial compulsory measure in criminal proceedings.Under the trend of a gradually lighter criminal structure and sentencing in judicial practice,the"Two Highs and Two Ministries"revised the"Several Provisions on Bail Pending Trial"in 2022,clarifying the objects that should be granted bail pending trial,strengthening execution supervision,improving supporting supervision measures,and standardizing work connections.This has further relaxed the application conditions and enhanced operability.However,upon examination,the expected value of bail pending trial has not been fully realized.There are still problems such as a low application rate of bail pending trial in cases of guilty pleas and plea bargaining,unclear assessment standards for social danger,and incomplete guarantee methods,supervision technologies,and mechanisms.It is necessary to further expand the scope of application of bail pending trial,establish a scientific quantitative assessment mechanism for social danger,increase guarantee methods,deepen digital monitoring,and clarify supporting mechanisms such as supervision obligations to implement the criminal judicial policy of"less arrest,cautious prosecution,and cautious detention",and protect the legitimate rights and interests of citizens.
