摘 要:在农村居民现实需求和乡村发展时代需要的双重驱动下,农村住宅居住权在充分发挥住宅居住使用的保障功能和财产利用的经营功能方面发挥着越来越重要的作用。以基础法理为支撑,居住权进入农村住宅并无显著障碍。而在农村住宅居住权实现过程中需区分保障型和经营型居住权,并在考量不同类型居住权特性后,确定具体的设立规则和效力规则,进而实现农村住宅居住权促进乡村经济社会发展的基本目标。Rural housing plays a fundamental role in the implementation of the rural revitalization strategy as a basic livelihood guarantee for rural residents and an important material resource for rural development.Driven by the practical needs of rural residents and the demands of the rural development era,the realization of the right to reside in rural housing can fully utilize the security function of residential use and the management function of property utilization.Under the support of basic legal principles,there are no significant obstacles to the entry of residential rights into rural residences.However,in the process of realizing the right to rural residential housing,it is necessary to distinguish between the residentialpurpose rights and commercial-purpose rights,and after considering the characteristics of different types of residential rights,determine specific rules for their establishment and effectiveness,in order to achieve the basic goal of promoting rural economic and social development through the right to rural residential housing.
