轻罪治理背景下审前刑事涉案财物处置研究

摘　　要：审前涉案财物处置在一定程度上影响着轻罪治理的效果。我国审前涉案财物处置面临诸多现实障碍。首先,审前涉案财物管理不规范,可能导致后续审理的干扰和证据不完整,影响诉讼效率;其次,涉案财物处置措施单一且强度超限,无法适应新型犯罪形态;再次,审前权利保障不足,当事人及利害关系人在涉案财物处置过程中处于弱势地位;最后,缺乏审前司法审查机制,使得涉案财物处置的合法性和正当性无法得到有效监督和保障。因此,有必要完善涉案财物管理机制,提高审前涉案财物处置措施的适应性,加强审前权利保障,并构建审前以检察机关为主导的中国特色准司法审查机制,以此促进审前涉案财物处置的效率和公正性,在一定程度上为轻罪治理提供更有效的支持。Pretrial disposal of involved assets significantly influences the efficacy of misdemeanor governance.In China,pretrial asset disposal encounters several practical impediments.Firstly,the management of pretrial assets involved in criminal cases is often irregular,which can result in subsequent trial interference and incomplete evidence,thereby diminishing litigation efficiency.Secondly,the measures for the disposal of such assets are singular and excessively severe,rendering them inadequate for addressing new types of crime.Thirdly,there is a lack of sufficient pretrial rights protection,placing the parties involved and stakeholders in a disadvantaged position during the asset disposal process.Finally,the absence of a pretrial judicial review mechanism means that the legality and legitimacy of asset disposal cannot be effectively supervised or ensured.Therefore,it is imperative to refine the asset management mechanism,enhance the adaptability of pre-trial disposal measures,strengthen the protection of pre-trial rights,and establish a quasi-judicial review mechanism led by the procuratorate with Chinese characteristics.These steps will promote the efficiency and fairness of pre-trial asset disposal and provide more effective support for the governance of minor crimes.
