摘  要:基于对Y省开展预防未成年人违法犯罪活动样本研究,发现罪错行为分级干预与预防保护目的具有一致性,深入分级干预机制内部,发现其具有独特的有效识别、合力干预、社会协同等功能,对有效预防未成年人犯罪,且尽可能避免未成年人免受侵害发挥着重要作用。本文从实务操作层面检验反思分级干预理论和实践存在的不足,重点解决干预对象、干预主体、干预方式、干预力量等分级干预制度落地落实难问题,对构建具有中国特色、符合我国国情、体现最有利于未成年人保护原则的罪错行为分级干预机制具有理论和实践意义。Based on a sample study on the prevention of juvenile delinquency in Y province,it was found that the hierarchical intervention of criminal behavior is consistent with the purpose of prevention and protection.By delving into the internal mechanism of hierarchical intervention,it was found that it has unique and effective functions such as identification,collaborative intervention,and social coordination,which play an important role in effectively preventing juvenile delinquency and avoiding harm to minors as much as possible.This article examines the shortcomings of the theory and practice of reflective graded intervention from a practical operational perspective,focusing on addressing the difficulties in implementing the graded intervention system,such as intervention objects,intervention subjects,intervention methods,and intervention forces.It has theoretical and practical significance for constructing a graded intervention mechanism for criminal and wrongful behavior with Chinese characteristics,in line with China's national conditions,and reflecting the most favorable principle for the protection of minors.
