摘　　要：为了满足司法实践的需求,实现刑事诉讼法的内在价值,在刑事诉讼司法解释中引入方法论具有必要性。当下,方法论应用于刑事诉讼司法解释过程还需要在建构刑事诉讼司法解释方法论的具体操作中寻求解决之道,这有赖于刑事诉讼司法解释方法论自身的发展与刑事诉讼司法解释领域研究的突破。将方法论应用于刑事诉讼司法解释过程具有可行性,相关学科的方法论体系及相关研究成果都能为刑事诉讼司法解释方法论的构建提供借鉴方案,只是在刑事诉讼司法解释方法论构建时,必须重视其自身的特殊性。方法论应用于刑事诉讼司法解释领域将会从多角度、在多方面呈现出蓬勃发展的趋势。It is necessary to introduce the methodology of judicial interpretation of criminal procedure in order to meet the practical needs of the judiciary and realize the intrinsic values of criminal procedure law.At present,the application of methodology in the judicial interpretation of criminal procedure,it also requires solutions through the specific operationalization of constructing such a methodology,which depends on the development of the methodology itself and the breakthroughs in research in the field of judicial interpretation of criminal procedure.It is feasible to apply the methodology to the process of judicial interpretation of criminal procedure,because the methodological frameworks of related disciplines and the research outcomes obtained can provide reference solutions for the construction of judicial interpretation methodology of criminal procedure,but the unique particularities of criminal procedure must be emphasized.In the future,the application of methodology in the field of judicial interpretation of criminal procedure is expected to flourish from multiple perspectives and dimensions.
