基于人格财产的宅基地退出意愿影响因素及补偿机制研究——以山东省寿光市为例

摘　　要：随着我国城镇化水平的不断提高,宅基地闲置问题日益凸显,与此同时,耕地和城市用地的紧张状况也在不断加剧。党的二十届三中全会明确提出促进城乡要素平等交换,深化土地制度改革。当前宅基地改革受阻的关键障碍是农民退出意愿低,宅基地补偿是影响农民退出意愿的重要因素。理论和统计分析表明宅基地是农民的人格财产,退出补偿应在市场价值基础上包含人格财产溢价。我国区域经济发展不平衡,宅基地退出改革应在经济较发达地区率先推进,由地方政府主导,构建一套基于人格财产的退出补偿机制。该机制包括补偿主体与对象、补偿项目、补偿依据、补偿方式和补偿标准。基于人格财产的退出补偿机制的落实将确保农民获得公平、合理的补偿,从而有效提升农民退出意愿,进而推动宅基地改革。The key obstacle to the reform of homestead is the peasants’low willingness to exit.The compensation is one of the main factors influencing the peasants’decision.Theoretic and statistical analysis show that the homestead is the personal property of peasants and the compensation for exit should include the personal property premium on the basis of market value.China’s regional economic development is not balanced,therefore the homestead exit reform should be implemented by the local government in advantage regions based on personal property exit compensation mechanism.The mech-anism is supposed to contain the subject and object,items,basis,methods and standard.The actualization of the compensation mechanism will make the peasants get fair and reasonable compensation,thus effectively enhance the peasants’will to exit,and then boost the reform of the homestead.
