摘 要:通过对2011年5月1日至2023年7月31日全国489个生产、销售不符合安全标准的食品罪案件量刑裁判的实证研究发现,我国法院在裁量生产、销售不符合安全标准的食品罪案件时,存在与从严惩治食品安全犯罪政策的偏离现象。运用单因素分析、关联性分析和结构方程模型等研究方法,深入探讨生产、销售不符合安全标准的食品罪量刑基本特征,分析案件所属地区、犯罪主体性别、年龄、文化程度、犯罪持续时间、犯罪人数、销售金额等不同因素对量刑的影响,揭示了当前我国生产、销售不符合安全标准的食品罪量刑上存在的问题,并就规范司法裁量权和提高刑事审判公平性提出建议。Through an empirical study of the sentencing decisions in 489 nationwide cases of food crimes involving the production and sale of unsafe food products from May 1,2011,to July 31,2023,it was discovered that Chinese courts deviate from the strict policies aimed at combating food safety crimes when determining sentences for cases involving the production and sale of unsafe food products.Using single-factor analysis,correlation analysis and structural equation modeling and other research methods,the basic sentencing characteristics of these food crime cases were examined,analyzing factors such as the region of the case,gender and age as well as education level of the offenders,duration of the crimes,number of offenders,and sales amounts,to uncover issues in the current sentencing practices for food crimes related to unsafe food products.Furthermore,recommendations were provided to standardize judicial discretion and enhance fairness in criminal trials.
