摘  要:自动驾驶技术迅速发展的同时,不可避免地带来了一系列新的刑事法律问题。其系统分级化、智能化等特点让相对滞后的法律规范体系应对乏力。在一起自动驾驶汽车引发的交通事故中,传统《刑法》很难认定除了驾驶者,还有哪些主体应当承担哪些刑事责任。为此,较好的选择是将关注点放在主体所负的注意义务上。通过明确不同自动驾驶情形中应负注意义务的主体、分析注意义务的限缩及扩展事由以及相应边界,达到合理分配各方主体的注意义务的目的,同时,对于厘清自动驾驶交通肇事主体的刑事法律责任具有一定的现实意义。With the rapid development of autonomous driving technology,a series of new criminal legal issues have inevitably emerged.The hierarchical and intelligent characteristics of its system make it difficult for the relatively lagging legal regulatory systemto cope.In a traffic accident caused by autonomous vehicle,it is difficult for the traditional criminal law to determine which subjects should bear which criminal responsibilities in addition to the driver.For this reason,a better choice is to focus on the duty of care that the subject bears.By clarifying the subjects who should bear the duty of care in different situations of autonomous driving,analyzing the reasons for the limitation and expansion of the duty of care,and the corresponding boundaries,the goal of reasonably allocating the duty of care among all parties can be achieved.At the same time,it has certain practical significance for clarifying the criminal legal responsibility of the subjects involved in autonomous driving traffic accidents.
