摘　　要：本文基于党的二十届三中全会关于制定金融法的精神,结合我国现阶段的金融形势,对我国金融法的定义从内涵与外延两个方面进行了反思与重构,批判性借鉴现有研究成果后,在领域法学视域下重新界定了金融的相关基本概念,明确了金融法的调整与适用范围,以实现金融法制定的系统化全覆盖。本文认为,我国现阶段制定金融法应当首先明确核心理念,即提高金融效率、保障金融安全,以及在横向交易与纵向监管关系中维护主体利益这三项基本原则,并通过立法的形式使其成为统领金融法的内层价值。在具体实践路径上应首先制定金融法通则,实现金融法制定的整体性与系统性;其次应构建和完善我国现行金融行业法体系,实现金融行业法彼此之间的协调性与衔接性;最后应梳理并整合我国现行金融政策,规范并灵活运用授权立法机制,实现金融法适用的灵活性与适应性。Based on the spirit of the Third Plenary Session of the 20th Central Committee of the Communist Party of China(CPC)regarding the formulation of financial law,and in conjunction with the current financial situation in China,this paper reflects on and reconstructs the definition of China's financial law from two perspectives:connotation and extension.This paper argues that the formulation of China's financial law at this stage should first clarify the core concepts,that is,thetl three basic principles of improving financial efficiency,ensuring financial security,and safeguarding the interests of entities involved in both horizontal transactions and vertical supervision.These principles should be established as thei inner values governing financial law through legislation.In terms of specific practical paths,the general principles of financial law should be formulated first,to achieve integrity and systematization in the creation of financial laws.Secondly,it is necessary to construct and improve the current legal framework of China's financial industry to ensure coordination and cohesion among its laws.Finally,it is essential to sort out and integrate existing financial policies,standardize and flexibly use the authorized legislative mechanism,and achieve flexibility and adaptability in the application of financial law.
