摘　　要：人体冷冻胚胎作为辅助生殖技术的核心“产物”,其处置所涉之纠纷案在司法裁决中面临法律依据缺失、处置之规则不一、法理情理难以平衡的三重困境。对此应数据化、类型化分析我国涉冷冻胚胎纠纷裁判文书,梳理人体冷冻胚胎法律属性的主流学说,并借鉴域外有关冷冻胚胎规制的典型实践,把明确冷冻胚胎的法律地位作为逻辑前提,且将之视为一种具有人身意义的“特殊的物”,在具体规制上可以“软性”规范文件来统一处置规则,再设立专门监管机构以形成我国涉人体冷冻胚胎处置的“规则-机构”法律体系。As the core"product"of assisted reproductive technology,the human frozen embryos are faced with the absence of legal basis of adjudication,inconsistent disposal rules and difficulties in balancing legal principles and reason in judicial practice.In this regard,it is necessary to analyze the judgment documents concerning frozen embryos in China by data and type,sort out the mainstream theory of the legal attribute of frozen embryos,and draw lessons from the typical foreign practice of frozen embryo regulation,take the legal status of frozen embryos as a logical premise,and regard it as a"special thing"with personal significance.In terms of specific regulations,the rules of disposal can be unified by"soft"normative documents,and then a special regulatory body can be set up to form a"rule-agency"legal system involving the disposal of human frozen embryos in China.
