公立医院医务人员职业道德失范的规制——以1973份司法判决书为分析样本

摘　　要：通过对1973份有关公立医院医务人员职业道德失范行为的判决书的分析可以发现,以贪污、受贿为主要表现形式的医务人员职业道德失范行为近年来呈下降趋势,但该行为持续时间较长、发生次数高,且涉及的行为人权力较大、医院级别较高。公立医院医务人员职业道德失范行为导致医患之间出现信任危机、造成患者就医质量下降并侵害了患者的合法权益。导致该行为发生的原因在于法律不完善、医务人员薪酬不合理、监管不充分和医院对文化建设重视不够。为规制公立医院医务人员职业道德失范行为,应从完善立法、提高医务人员薪资待遇,强化监管和加大医院文化建设力度入手。According to the analysis of 1973 judgments on professional ethics anomie of medical staff in public hospitals,it is found that the main forms of such behavior,corruption and bribery,have been declining in recent years,but the duration is longer,the occurrence frequency is higher,the perpetrator has greater power and the level of hospitals involved is higher.The professional ethics anomie of medical staff in public hospitals leads to the crisis of trust between doctors and patients,causes the decline of the quality of medical treatment of patients and infringes the legitimate rights and interests of patients.The causes are imperfect laws,unreasonable salaries of medical staff,inadequate supervision and insufficient attention to cultural construction in hospitals.Therefore,it should be regulated by perfecting legislation,raising the salary of medical staff,strengthening supervision and strengthening the construction of hospital culture.
