丝绸之路经济带法务区仲裁服务机制构建探析

摘　　要：国务院印发的《中国(新疆)自由贸易试验区总体方案》强调支持建设“丝绸之路经济带法务区”,仲裁的优越性以及对法务区的积极作用说明仲裁服务机制构建是丝绸之路经济带法务区建设的重要组成部分。目前,丝绸之路经济带法务区仲裁服务机制建设仍处于萌芽阶段,区域内本土仲裁机构行政化色彩浓厚,仲裁服务人才匮乏。基于此,应结合新疆仲裁机构的发展现状,借鉴国内外国际仲裁中心仲裁服务机制的构建经验,推动“丝绸之路经济带法务区”仲裁服务主体的改革创新,构建高效的仲裁服务程序和与时俱进的仲裁服务规则,加大仲裁服务人才的引育力度。The overall plan of China(Xinjiang)Pilot Free Trade Zone issued by the State Council emphasizes the support for the construction of the legal area of the Silk Road Economic Belt.The superiority of arbitration and its positive role in the legal area indicate that the construction of arbitration service mechanism is an important part of the construction of the legal area of the Silk Road Economic Belt.At present,the construction of arbitration service mechanism in the legal area of the Silk Road Economic Belt is still in its infancy.The local arbitration institutions in the region have a strong administrative color and lack of arbitration service talents.Based on this,we should combine the development status of Xinjiang arbitration institutions,learn from the construction experience of arbitration service mechanism of international arbitration centers at home and abroad,promote the reform and innovation of arbitration service subjects in the'Silk Road Economic Belt Legal District’,build efficient arbitration service procedures and arbitration service rules that keep pace with the times,and increase the introduction and cultivation of arbitration service talents.
