摘　　要：在执法司法过程中,利益衡量是常用的方法。利益衡量方法是对据法阐释元规则的拓展,通过利益衡量的介入,迎合法律逻辑的道义要求。这对强化依法办事之法的正当性,限制执法司法的任意性有积极意义。然而在法理学界,对是否存在限制恣意的利益衡量规则还存在质疑。研究发现,基于不可通约的信条不会阻碍利益衡量规则建构;利益衡量是法律续造的特殊方法,是用开放的体系思维,在语境中重新塑造法律的意义,法律续造需要利益衡量规则的约束。虽然利益衡量方法具有权衡、权变的思维特点,但也作为一般方法指引思维甚或评判思维结果的正当性。利益衡量规则通常以利益衡量方法的分类为前提,利益衡量方法可分为要素建构方法、体系矫正方法、解释协调方法。通过对利益衡量规则的拟制,规范利益衡量方法的适用。In the process of law enforcement and judicial proceedings,methods of the halancing of interests are commonly employed.The balancing of interests serves as an extension of the meta-rules of legal interpretation,addressing the moral imperatives of legal logic through its intervention.This has positive implications for reinforcing the legitimacy of law-based governance and limiting the arbitrariness of law enforcement and judicial practices.However,within jurisprudence,there remains skepticism regarding the existence of rules for the balancing of interests that can effectively constrain arbitrariness.Research indicates that irreconcilable beliefs do not hinder the construclion of the rules for the balancing of inleresls.The balancing of inlerests is a unique method of legal reconslruclion thal employs an open syslems approach to reshape the meaning of law within context,necessitating the constraints of rules of the balancing of interests in the process of legal reconstruction.Although the methods of balancing interests are characterized by their evaluative and adaptive thinking,they also serve as a general methodological guide for reasoning and assessing the legitimacy of outcomes.The rules of the balancing of interests typically presuppose a classification of the methods of the balancing of interests,which can be categorized into the methods of element construction,systemic correction,and interpretative coordination.By formulating the rules for the balancing of interests,the application of the methods of the halancing of interests can he standardized.
