摘 要:新时代流域立法在流域管理体制方面实现了重大制度创新,即明确建立流域协调机制。然而,当前流域协调机制的施行尚显滞后,地方间的协作机制停留在各自为政的层面,未能充分发挥流域协调机制的功能。流域协调机制促进我国从流域管理向流域治理转变,是实现流域环境资源一体化治理的重要机制,其完善应以法治化为核心,通过立法明确其组织形态与运行规则,并辅以多元化的监督机制。由此,基于流域协调机制所蕴含的统筹协调的系统论思维,应当完善流域协调机制的组织架构、职能范畴、适用程序以及监督责任。In the new era,river basin legislation has achieved significant institutional innovation in river basin coordination mechanismand clearly established river basin coordination mechanism.However,the implementation of thecurrent river basin coordination mechanism is still lagging behind,with inter-local collaboration mechanisms still operating in a fragmented manner,failing to fully realize the functions of the river basin coordination mechanism.The river basin coordination mechanism promotes the transformation from river basin management to river basin governance in China,and it is an important mechanism to realize the integrated management of river basin environmental resources.Its improvement should be centered on legalization,with legislation clarifying its organizational structure and operational rules,supplemented by diversified oversight mechanisms.Therefore,based on the system theory of overall coordination contained in the river basin coordination mechanism,it is essential to refine the organizational framework,functional scope,operational procedures,and supervisory responsibilities of the river basin coordination mechanism.
