探望权强制执行的现实困境及其纾解

摘　　要：探望权是家庭法中不可或缺的一项重要权利,对促进家庭和睦、社会和谐具有重要作用。探望权的执行应当以未成年子女权益保护为出发点,同时保障探望权人的探望权,形成融洽的亲子关系与和谐的家庭关系。然而我国探望权执行实践中存在一些问题亟待完善,如探望权执行依据内容不具体、强制执行措施笼统单一、中止探望规定模糊、探望权执行配套机制缺失等。对此,应当明晰探望权执行依据的内容,创新执行手段,明确强制执行措施的适用顺序,细化中止探望的实体标准和程序规定,并通过设立探望服务中心、建立未成年子女利益代理人制度构建探望权强制执行配套机制,充分借助和发挥社会组织的力量,提高探望权执行质效。The right of visitation is an important right in family law,which plays an important role in promoting family harmony and social stability.The enforcement of visitation rights should be based on the protection of the rights and interests of underage children,while safeguarding the visitation rights of visitation rights holders,forming harmonious parent-child and family relationships.However,there are some problems in the practice of enforcing visitation rights in China that urgently need to be improved,such as the lack of specific basis for enforcing visitation rights,vague and singular inforcement measures,vague provisions for suspending visitation,and a lack of supporting mechanism for enforcing visitation rights.In this regard,it is necessary to clarify the content of the basis for the enforcement of visitation rights,innovate the means of enforcement,clarify the order of application of compulsory enforcement measures,refine the substantive standards and procedural provisions for suspending visitation,and establish a visitation service center and a system for representing the interests of underaged children to build a supporting mechanism for the inforcement of visitation rights,fully leveraging and exerting the power of social organizations to improve the quality and effectiveness of visitation rights enforcement.
