摘　　要：新就业形态劳动基准制度建构是平衡劳资之间失衡的法律地位,解决目前我国新就业形态劳动用工存在的工作时间和工作强度难以衡量、劳动报酬稳定性欠缺、劳动安全卫生保护缺失以及劳动处罚过重问题,强化新就业形态劳动者权益保障的需要。新就业形态劳动基准应该以核定工作时间的平台算法设计标准为出发点,明确新就业形态劳动者的薪酬规则和奖惩规则,以保护生命健康权为优先原则和重点内容。我国应该在总结、借鉴域外立法和本土实践经验的基础上,从完善立法体系建设、加强对数据和算法的监督、创新工会协商协调机制以及强化平台企业的自律性四个方面提出切实可行的劳动基准制度建构方案。The construction of the labor standards system for new forms of employment is a means of balancing the imbalanced legal status of labor and capital,resolving the current problems in China’s new forms of employment in terms of the difficulty of measuring working hours and intensity of work,the lack of stability in remuneration,the lack of protection for labor safety and health,and excessive labor penalties,as well as the need to strengthen the protection of the rights and interests of workers in new forms of employment.The new employment form labor standards should be based on the design standards of the approved working time algorithm,clarify the salary rules and reward and punishment rules for platform workers,and prioritize the protection of the right to life and health as the key content of constructing the new employment form labor standards.China should,on the basis of summarizing and drawing on extra-territorial legislation and local practical experience,put forward a practical proposal for the construction of the labor standards system in four areas:improving the construction of the legislative system,strengthening the supervision of data and algorithms,innovating the trade union consultation mechanism,and reinforcing the self-regulation of platform enterprises.
