摘　　要：拒不履行信息网络安全管理义务罪的设立是刑法维护信息网络安全管理秩序的重要举措,但在义务的设置上内容模糊、欠缺类型化。网络服务提供者的义务类型化分析离不开主体的类型化,以控制力理论为标准可将其分为网络浅层、中层、深层服务提供者三类。不同的网络服务提供者对网络信息的控制能力不同,其承担的义务内容也应当有所不同,根据本罪所保护的法益以及法律规定的义务,可对其义务进行合理配置。To preserve the order of information network safety administration,penal legislation has established the guilt of rejecting to meet the liability of information network security management.However,the content of the liability setting is ambiguous and lacks typification.It is difficult to separate the categorization of subjects from examining the liability classification of network service purveyors.They fall into three categories:shallow,medium,and deep network service purveyors,according to the theory of control.The ability to regulate network information varies among these service purveyors,and consequently,their liabilities should also differ.Their liabilities can be logically organized based on the legal interests safeguarded by this crime and the corresponding legal requirements.
