摘　　要：囿于知识产权的无形特性、价值不稳定和侵权易发难控,从保护交易安全和防控金融风险角度,知识产权能否作为融资租赁的标的物在业内仍存在一定争议,因此也一定程度制约了知识产权融资租赁的快速发展。但作为企业一种新的融资渠道,相信会在未来发挥更加重要的作用,为推动我国科技创新和企业发展做出更大的贡献。在此背景下,本文通过对知识产权融资租赁法律属性、特殊性比较研究以及法律风险的探索分析,以期从合同条款、风险防控措施方面提出可行性建议,为企业实施知识产权融资租赁提供参考。Due to the intellectual property,unstable value and easy infringement,there are still some disputes in the industry about whether intellectual property can be used as the subject matter of finance.But it is believed that it will play a more important role in the future and make greater contributions to promoting China’s scientific and technological innovation and enterprise.In this context,this article explores and analyzes the legal attributes,special features and legal risks,with the aim of putting forward suggestions of contract terms and risk prevention and control measures,so as to provide references for enterprises to implement intellectual property finance leasing.
