摘　　要：执行转破产程序是我国司法实践过程中的一种创新。但当下的“执转破”程序仍缺乏有效的信息化审理系统,故需要通过政府来搭建破产案件的信息平台,既便捷了实践中法官的操作,也利于节省当事人在该类案件中的所需成本。同时,不仅要在启动程序上纳入职权主义作为补充,也要在未来继续探索构建简易破产程序,实现繁简分流,进一步强化破产申请人的动力,转变其对“执转破”的态度,从不敢破不想破的状态脱离出来,并形成“执破一体”的工作机制,真正实现“执转破”的良性运行。Execution to insolvency program is an innovation in the process of judicial practice in China.An information platform for insolvency cases should be built by the government due to inefficient informational trial system,so as to facilitate the operation of the judges in practice and save litigants’costs in the cases.The doctrine of competence should be supplemented into the commencement procedure,and a simple insolvency procedure should be built to separate the cases,strengthen the motivation of the insolvency applicants,change their attitude to the“enforcement to insolvency”,establish a coordinated working mechanism,and realize a fine operation.
