摘　　要：农业对外合作是“一带一路”倡议的重要内容,法治是保障农业对外合作稳定发展的长效机制。当下基于对农业对外合作立法创新实践演进的分析,涉及农业对外合作领域的法律体系仍然不健全。农业对外合作领域法律体系的完善需加强顶层设计,遵循协调互补原则、市场运营原则、协调互补原则。横向层面,构建宏观的法治环境;横向层面,制定农业对外合作专门行政法规;配套层面,完善外汇管理条例,以此来夯实我国农业对外合作的“母国”制度,最终实现在法治轨道上推动农业对外合作的稳定长期发展。Agricultural external cooperation is an important part of the“Belt and Road”initiative,and the rule of law is a long-term mechanism to ensure the stable development of agricultural external cooperation.At present,based on the analysis of the evolution of Chinese agricultural foreign cooperation legislation,the legal system in the field of agricultural foreign cooperation is still not perfect.In order to perfect the legal system of agricultural foreign cooperation,we should strengthen the top-level design and follow the principles of coordination and complementarity,market operation and coordination and complementarity.At the horizontal level,we should establish a macro-legal environment;at the horizontal level,we should formulate special administrative regulations on agricultural foreign cooperation;at the complementary level,we should improve the regulations on foreign exchange management,in order to tamp our country's agricultural foreign cooperation“Home country”system,the ultimate realization of the rule of law on the track to promote the stable long-term development of agricultural foreign cooperation.
