摘　　要：随着移动互联网技术和智能通信设备的不断发展,部分传统犯罪借助“网约”模式逐渐完成了自身“结构性升级”。“网约迷奸”系传统迷奸犯罪在移动互联网技术加持下衍生出的新型犯罪,并呈现出多元化、复杂化、动态化的特点。当下,此类犯罪面临着证据固定难、线索转化难、案件经营难等困境。有必要在“专业+机制+大数据”新侦查思维的引领下,构建侦查工作新阵地,打造合成作战新模式,形成侦查工作新支撑,从而构建网约迷奸犯罪的侦查治理新模式。With the continuous development of mobile Internet technology and intelligent communication equipment,some traditional crimes have gradually completed their“structural upgrade”with the help of the“network contract”model.“Online date rape”is a new type of crime derived from traditional date rape crime with the support of mobile Internet technology,and presents the characteristics of diversification,complexity and dynamic.At present,this kind of crime faces the difficulties of evidence fixing,clue transforming and case management.Under the guidance of the new investigative thinking of“professional+mechanism+big data”,it is necessary to build a new position of investigative work,create a new mode of synthetic combat,and form a new support for investigative work,so as to build a new mode of investigation and governance of online rape crime.
