摘　　要：基于对中国留日法学“课程博士”学位论文的考察,可以简要回顾改革开放四十年来中国法科学生留学日本的基本状况。四十年来,中国法科学生留日数量不断增加,在专业分布、论文选题等方面的变化都有迹可循,并且逐渐呈现出就读学校集中、博士论文指导教师集中的趋势。中国留日法科学生作为中日法学交流的重要主体,为日本对中国法的研究提供了独特的中国视角,拓展了其对中国法研究的深度与广度。同时,通过助力中日法学交流平台的搭建与完善,推动我国法学界全面引入判例研究,加速日本法学作品在华的翻译与出版,中国留日法科学生丰富了中国法学学科知识、扩宽了中国法学研究视野。对留日学生个人而言,远赴重洋虽会面临多重考验,但也能够提升其教育背景与专业性、促成职业兴趣的多元化趋势,以及让个人更加重视学术规划的必要性。就国家层面而言,留日法学课程博士借助法学知识移植与消化思维,能够将日本法学研究的知识内容与中国法学知识的本土化相结合,为中国法学知识自主性做出了突出的贡献。Based on the investigation of the“course doctoral”dissertations of Chinese law students studying in Japan,we can briefly review the basic situation of Chinese law students studying in Japan over the past 40 years of reform and opening up.Over the past 40 years,the number of Chinese law students studying in Japan has continued to increase,and there are traces of changes in professional distribution,thesis topics,etc.,and there is a trend of concentration in the schools they attend and the concentration of doctoral dissertation supervisors.As an important subject of Sino-Japanese legal exchanges,Chinese law students studying in Japan have provided Japan with a unique Chinese perspective on Chinese law and expanded the depth and breadth of its research on Chinese law.At the same time,by helping to build and improve the Sino-Japanese legal exchange platform,promoting the comprehensive introduction of case studies in my country’s legal community,and accelerating the translation and publication of Japanese legal works in China,Chinese law students studying in Japan have enriched Chinese legal knowledge and broadened the horizons of Chinese legal research.For individual students studying in Japan,although going overseas will face multiple challenges,it can also improve their educational background and professionalism,promote the diversification of professional interests,and make individuals pay more attention to the necessity of academic planning.At the national level,the group of law students studying in Japan,with the help of legal knowledge transplantation and digestion thinking,was able to combine the knowledge content of Japanese legal research with the localization of Chinese legal knowledge,making outstanding contributions to the autonomy of Chinese legal knowledge.
