摘 要:学界对村规民约司法运用的讨论基本集中于民事诉讼领域,有必要将关注点从民事诉讼领域拓展至行政诉讼领域。在行政诉讼中,村规民约经过受案范围与法源的判断,被运用至行政裁判的说理当中,发挥着增强说服力、逻辑性与贴合性的重要功能。实践中,行政法官对村规民约的运用主要在行为支撑依据、行为本身性质与行为附带审查三个方面存在着明显的选择分歧,其根源主要在于村规民约在法源地位上、性质甄别上与审查路径上存在的不确定性。为进一步优化行政诉讼中的村规民约运用,可以尝试从明晰村规民约法源地位、厘清自治行为构成要件、建构分阶层的审查程式上予以针对性探讨,以期恰当发挥村规民约的实际效能。The discussion of the judicial application of village rules and regulations in academia basically focuses on the field of civil litigation,and it is necessary to expand the focus from the field of civil litigation to the field of administrative litigation.In administrative litigation,village rules and regulations are used in the reasoning of administrative adjudication after the judgment of the scope of accepted cases and legal source,playing an important role in enhancing persuasiveness,logic and fittingness.In practice,the application of village rules and regulations by administrative judges is mainly based on three issues:the basis of behavior,the nature of behavior itself and the incidental review of behavior.However,there are obvious differences in choice,which mainly stems from the uncertainty of village rules and regulations in the legal source status,the nature screening and the review path.In order to further optimize the application of village rules and regulations in administrative litigation,we can try to make targeted discussions from the analysis of the legal source status ofvillage rules and regulations,the re-identification of the constituent elements of autonomous behavior,and the construction of hierarchical review procedures,in order to properly play the actual effectiveness of village rules and regulations.
