摘　　要：一桩彩礼诉讼,从理性层面来看,是一场完整、规范的民事诉讼的展开过程,从“话语”视角来看,则是一场复杂、生动的多话语交际与博弈过程,在这个过程中,“想象中的法律世界”被建构,基层司法在面对民间风俗时的运作逻辑也得以揭示。通过对豫北县彩礼诉讼司法裁判文书及卷宗材料中双方当事人、主审法官在“法律话语”“道德话语”“治疗性话语”间转换运用的实证考察,彩礼诉讼中多话语策略之间的竞争与妥协、话语权力与话语力量之间的博弈关系得以展现,也从一个侧面揭示出我国基层司法在面对民间风俗时衍生出的治理逻辑以及浓厚的实践技艺,地方性知识与公共性知识的二元对立局面通过基层司法的运作也得到了消弭与溶解。From the rational level,a litigation of betrothal gifts is a complete and standard civil litigation process,however,from the perspective of“discourse”,it is a complicated and vivid multi-discourse communication and game process.In this process,the“imaginary legal world”is constructed and the operational logic of justice at the grass-roots level in the face of folk customs is also revealed.Through the empirical investigation on the conversion and application of“legal discourse”、“moral discourse”and“therapeutic discourse”of both parties and the presiding judge in judicial documents and dossier materials in the litigation of betrothal gifts of a County in North of Henan,the competition and compromise among multi-discourse strategies in the litigation of betrothal gifts as well as the game relation between discourse right and discourse power are revealed,and the governance logic derived from the justice at the grass-roots level when facing and handling such tension as well as the strong practical skills are revealed.The dual opposition between local knowledge and public knowledge will be eliminated and dissolved through the operation of grass-roots justice.
